PADEL X CLUB TERMS AND CONDITIONS

Welcome to Padel X Club ("Padel X", "we", "our", "us"). These Terms and Conditions govern your use of our website, facilities, bookings, memberships, events, coaching sessions and other services.

By accessing our website, creating an account, making a booking, purchasing a membership or using any Padel X Club facility or service, you agree to comply with these Terms and Conditions and any additional Club policies referred to within them.

If you do not agree with these Terms and Conditions, you should not use our website, facilities or services.

1. USE OF OUR WEBSITE AND SERVICES

1.1 Eligibility

You must be at least 18 years old to create an account or enter into a booking or membership agreement with Padel X Club, unless otherwise expressly permitted by us for junior activities.

1.2 User Accounts

Certain services may require you to create an account through Padel X Club or one of our booking partners, including Padel Mates.

You are responsible for:

ensuring that your account information is accurate and up to date;
maintaining the security and confidentiality of your account;
ensuring bookings are made for their intended purpose; and
complying with all applicable Club rules and policies.

Memberships, discounts, booking privileges and account benefits are personal to the account holder unless expressly stated otherwise.

1.3 Prohibited Activities

You must not use our website, facilities or services in any way that:

violates applicable laws or regulations;
infringes the intellectual property or other rights of Padel X Club or any third party;
interferes with the operation of our website, booking systems or facilities;
harasses, threatens, defames or causes harm to another person;
misuses a membership, discount, promotional offer or booking privilege;
uses recreational bookings or membership benefits for unauthorised commercial activity; or
breaches any Padel X Club policy, Code of Conduct or facility-specific rules.

2. BOOKINGS AND MEMBERSHIPS

Bookings and memberships are subject to the prices, availability, booking windows, cancellation terms and benefits displayed at the relevant Padel X Club venue or within our booking platform at the time of purchase.

Membership benefits are intended for the personal and recreational use of the member unless Padel X Club has expressly agreed otherwise in writing.

We reserve the right to amend court availability, operating hours, programming and booking availability where reasonably necessary for operational, maintenance, safety, event or venue requirements.

3. COMMERCIAL BOOKINGS AND ACTIVITY

3.1 Commercial Activity

Any booking or activity undertaken for commercial gain, financial benefit, business promotion or on behalf of an organisation, brand, coach, event organiser or other commercial enterprise may be treated as a Commercial Booking by Padel X Club.

This may include, but is not limited to:

paid tournaments, leagues, Americanos or organised playing sessions;
events where participants are charged an entry or participation fee;
coaching or instruction provided for payment;
corporate or sponsored events;
externally promoted events;
activities operated or advertised under a separate commercial brand;
product demonstrations, promotional activity, filming or activations; and
any organised activity where the organiser receives direct or indirect commercial benefit.

3.2 Prior Approval

Commercial activity must not be organised, advertised or operated at a Padel X Club venue without prior approval from Padel X Club.

Where applicable, additional approval may also be required from the relevant venue, landowner, Estate or facility partner.

3.3 Recreational Memberships

Recreational memberships, membership discounts, member court rates, Club Credits or other personal booking benefits must not be used to obtain court time for commercial activity unless expressly authorised by Padel X Club in writing.

Where Padel X Club reasonably believes that a recreational membership or discounted booking has been used for commercial purposes, we reserve the right to:

cancel or amend affected bookings;
remove applicable membership discounts or benefits;
charge the appropriate commercial booking rate;
suspend or terminate booking or membership privileges; and/or
require the organiser to enter into an approved commercial arrangement before further activity takes place.

3.4 Commercial Booking Requirements

Any commercial arrangement will require, where applicable:

Court times, the number of courts, session lengths and frequency to be agreed in advance. Court allocation remains at the discretion of Padel X Club, taking account of member demand and the wider operational requirements of the Club.
Courts to be booked and paid for under the agreed commercial arrangement and not through individual recreational memberships or associated membership discounts.
The names of all participating players to be registered against the relevant booking through Padel Mates or another booking system specified by Padel X Club.
Catering to be provided through approved venue arrangements or, where an external provider is proposed, to receive prior approval from Padel X Club and/or the relevant venue or Estate.
The organiser to ensure that all relevant music licences, permissions and other regulatory requirements are in place where music or entertainment forms part of the activity.
Evidence of appropriate insurance covering the commercial activity being undertaken.
Relevant risk assessments, health and safety documentation and any applicable sporting, coaching or professional qualifications or certifications to be provided upon request.
Prior approval from Padel X Club and, where applicable, the venue or Estate for any associated commercial activity taking place on site.

These requirements are necessary to ensure commercial activities taking place at Padel X Club venues are appropriately managed and that suitable responsibilities, insurance, licences, permissions and health and safety arrangements are in place.

3.5 Commercial Booking Approval

Approval of one commercial booking or event does not constitute ongoing approval for future activity.

Court availability, number of courts, session frequency and permitted activities will be considered on a case-by-case basis and remain subject to the operational requirements of Padel X Club.

Padel X Club may impose reasonable conditions on any commercial booking, including restrictions on court allocation, timings, branding, advertising, catering, music, coaching, photography, filming and other associated activity.

4. PRIVACY

Our Privacy Policy governs how we collect, process, use and protect personal information.

By using our website and services, you acknowledge that your personal information may be processed in accordance with our Privacy Policy.

5. INTELLECTUAL PROPERTY

5.1 Ownership

Unless otherwise stated, all content made available through the Padel X Club website and associated services, including logos, branding, text, graphics, photographs, designs and software, is owned by or licensed to Padel X Club and is protected by applicable intellectual property laws.

This excludes third-party content and public stock imagery used under appropriate licences.

5.2 Permitted Use

We grant you a limited, non-exclusive and non-transferable right to access and use our website and services for their intended purpose.

You may not reproduce, distribute, commercially exploit, modify or republish Padel X Club intellectual property without our prior written permission.

6. THIRD-PARTY SERVICES AND CONTENT

Our website or services may contain links to, integrate with or redirect users to third-party websites, applications, payment providers or booking platforms.

Padel X Club is not responsible for the availability, content, security or practices of third-party services that are outside our control.

Use of third-party services may also be subject to separate terms and privacy policies issued by those providers.

7. WEBSITE AVAILABILITY

We aim to keep our website and online services available and functioning effectively but cannot guarantee uninterrupted or error-free access.

Access may occasionally be affected by maintenance, technical faults, third-party service outages, circumstances outside our reasonable control or other operational requirements.

8. LIABILITY

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

To the fullest extent permitted by law, Padel X Club will not be responsible for indirect or consequential losses arising from the use or inability to use our website or services.

Users remain responsible for ensuring they are physically able to participate in sporting activity and for following all safety instructions, venue rules and reasonable directions given by Padel X Club staff, coaches or representatives.

9. PERSONAL DATA

Padel X Club is committed to handling personal information in accordance with applicable UK data protection legislation, including the UK GDPR and Data Protection Act 2018.

10. USER-GENERATED CONTENT

Where users are permitted to submit, upload or publish content through our services, they remain responsible for that content and must ensure that it does not infringe applicable laws or the rights of third parties.

We reserve the right to remove or restrict access to content that we reasonably believe breaches applicable laws, these Terms and Conditions or our Club policies.

11. SUSPENSION AND TERMINATION

We reserve the right to suspend or terminate access to our services, facilities, memberships or booking privileges where reasonably necessary, including where a user:

breaches these Terms and Conditions;
breaches a Club policy or Code of Conduct;
misuses membership benefits or booking privileges;
undertakes unauthorised commercial activity;
behaves in a manner that may endanger or materially disrupt other users, staff or Club operations; or
acts unlawfully.

12. CHANGES TO THESE TERMS

We may update these Terms and Conditions periodically to reflect changes to our services, facilities, policies, operational requirements or applicable legal requirements.

The most recent version will be published on our website together with the date it was last updated.

Continued use of our services following an update constitutes acceptance of the revised Terms to the extent permitted by law.

13. GOVERNING LAW

These Terms and Conditions are governed by the laws of England and Wales.

Any dispute arising in connection with these Terms will be subject to the applicable jurisdiction of the courts of England and Wales, subject to any mandatory rights available to consumers.
